Energetska zajednica poslala vlastima BiH nacrt Zakona o gasu
BEČ – Sekretarijat Energetske zajednice (EZ) uručio je 20. oktobra federalnim vlastima Bosne i Hercegovine nacrt Zakona o gasu usaglašen sa Trećim energetskim paketom. Kako je objasnio direktor Sekretarijata g. Janez Kopač, ako bude usvojen, zakon će u oblasti gasa uvesti BiH u zakonodavne okvire Trećeg energetskog paketa i na taj način okončati postojeći prekršajni postupak koji se zbog neprimjene tog zakonodavstva vodi protiv BiH.
Sekretarijat je spreman pomoći Bosni i Hercegovini u nastojanju da je jedino moguće rješenje usklađeno odredbama Trećeg energetskog paketa za Bosnu i Hercegovinu da ima jednog državnog energetskog regulatora, sa nadležnostima koje mu može dodeliti jedino zakon.
Kako neki političari insistitraju u stavu da ne treba da postoji institucija na nivou države, Sekretarijat je ovaj nacrt Zakona poslao tek nakon nedavnih izbora u BiH, kako ne bi dodavao ulje na vatru populističkih rasprava uoči izbornog dana, navodi se u saopštenju.
Rok za transpoziciju Trećeg energetskog paketa za plin i električnu energiju je 1. januara 2015.

[learn_more caption=”20 Oct 2014 – Secretariat delivers Third Energy Package-compliant draft gas law to Bosnia and Herzegovina”] As called for by the Ministerial Council, the Energy Community Secretariat submitted today a Third Energy Package-compliant draft gas law to the relevant authorities of Bosnia and Herzegovina. “If adopted, the law would bring Bosnia and Herzegovina’s legal framework in the gas sector in compliance with the Third Energy Package and thus bring to an end the existing dispute settlement case,” explained Director Kopač. “The lack of an appropriate legal framework constitutes a very serious obstacle to the development of the gas sector in Bosnia and Herzegovina and harms energy consumers. This draft law could be immediately taken by the country’s Minister and the national discussion on the adoption of proper legislation could proceed. The Secretariat is ready to assist Bosnia and Herzegovina in this endeavor. The only possible solution to be compliant with the Third Energy Package for Bosnia and Herzegovina is to have one state energy regulator and this institution can be given competences only by a law. Because some politicians are insisting on the non-existence of a state level institution, the Secretariat sent this draft law only after the recent elections in order not to fuel populist discussions in the run-up up to election day. ” In the Conclusions adopted by the Ministerial Council on 23 September 2014, the Ministers, in accordance with Article 92 of the Treaty, declared the existence of a “serious and persistent breach” by Bosnia and Herzegovina of its obligations in the gas sector namely by failing to implement Directive 2003/55/EC and Regulation (EC) No 1775/2005, and tasked the Secretariat to offer assistance to Bosnia and Herzegovia in drafting the necessary legislation. The lack of a regulatory authority to cover the entire gas sector in Bosnia and Herzegovina as well as the lack of unbundling of transmission system operators, adequate network tariffs and market opening were some of the issues of non-compliance underlined by the Ministerial Council. Bosnia and Herzegovina committed to present gas legislation in compliance with the Third Package to the Ministerial Council in 2015. The discussion on imposing sanctions on Bosnia and Herzegovia due to the country’s breach of the Treaty was postponed until the next Council meeting.Bosnia and Herzegovina was also given a Third Package-compliant draft legal framework for the electricity sector for the state and entity levels on 24 January 2014. The draft legal framework was developed within the Instrument for Pre-Accession Assistance (IPA) Project for Development of an EU acquis-compliant electricity legislative framework in Bosnia and Herzegovina in close cooperation with the Secretariat. Unfortunately the process of its adoption has not yet started. The deadline to transpose the Third Energy Package for gas and electricity is 1 January 2015.[/learn_more]
